Central to the still-nascent normative literature on counterspeech is the widespread belief that citizens should engage discursively with haters and the effects of hate speech. It is also increasingly clear that discursive engagement with intolerant members of society should be understood as a continuous and extended series of different and connected actions. Much less has been said about the ways that attempts in persuasion and direct responses to hate speech relate to one another and about when specific counterspeech actions should (...) happen. This essay advances a more expansive and refined account of counterspeech, which is understood as a combination of continuous discursive engagement with intolerant members of society and acts of distancing from haters (shaming, correcting falsehoods, “Not in my name” campaigns, protests, and forms of discursive exit). After reconsidering discursive agency distribution (that is, who is an active participant, how, and when) around public hate speech, I show that continuous discursive engagement with intolerant members of society should be interrupted by visible acts of distancing when haters make hateful representative claims. Despite the impressive body of evidence supporting the existence of a mirror neuron (MN) system for action, the original claim regarding its crucial role in action understanding remains controversial. Emma Borg has recently launched a sharp attack on this claim, with the aim of demonstrating that neither the original version nor the subsequent revisions of the MN hypothesis tell us very much about how intentional attribution actually works. In this article I take up the challenge she issues in the title (...) of her paper (If Mirror Neurons are the Answer, What was the Question?) and argue that what MNs offer is not as Borg claims 'an extremely limited' picture of action understanding but rather an enriched picture that brings to light aspects of social cognition hitherto ignored in the mind-reading literature, showing how intentional motor components of action can shape social cognition prior to and apart from any forms of deliberate mentalizing. While most of the literature has attempted to justify harsh and soft containment given some fundamental commitments of political liberalism, I focus on how justified forms of containment can in themselves be deemed effective. This article shows that a reading of Rawls allows for a comparison of different containment practices based on their capacity to protect the stability of liberal democracies under serious threat. And, in making it possible to compare harsh and soft containment, I evaluate immediate stability gains against (...) citizens’ judgements about their liberal democratic institutions. (shrink)

In this paper I take it for granted that legal institutions are artifacts. In general, this can very well be considered a trivial thesis in legal philosophy. As trivial as this thesis may be, however, to my knowledge no legal philosopher has attempted an analysis of the peculiar reality of legal phenomena in terms of the reality of artifacts, and this is particularly striking because there has been much discussion about artifacts in general philosophy (specifically analytic metaphysics) over the last (...) twenty years. In particular, the concepts of intention, function, plan of action, and history are in competition to explain the ontology of artifacts, and a similar competition can be found at the core of legal theory. Such a striking parallelism between the domain of artifacts and that of legal institutions is a clue for legal ontology that deserves further attention: I will offer my own interpretation of this parallelism in the first part of this paper (Sections 2 and 3). In providing a theory of legal institutions as artifacts, one could be led to the conclusion that law is essentially an artificial phenomenon, something which does not bear any significant relationship to the natural domain. However, I think that such a conclusion would be mistaken. In fact, this is the second thesis I want to explore in this paper: not only that legal institutions are artifacts, but also that they can be artifacts which in some sense "mirror," or imitate, some descriptions of the natural, pre-social reality we live in. What I would like to show is not that legal institutions are "natural" in the sense that they have some feature which is not human-dependent, as some natural law theorists would say, but rather that their conceptual content can depend on our conceptualization of the natural domain despite being entirely artifactual. This is what I will call the "institutional mimesis" behind several important instances of legal artifacts, and I will deal with it in the second part of this paper (Sections 4 and 5). (shrink)

Although the notion of constitutive rule has played an important role in the metaphysical debate in social and legal philosophy, several authors perceive it as somewhat mysterious and ambiguous: the idea of a specific kind of rules that are supposed to be “magically” constitutive of reality seems suspicious, more a rationalistic fiction than a genuine explanation. For these reasons, reductionist approaches have been put forward to deflate the explanatory role of this notion. In this paper, I will instead try to (...) defend constitutive rules. My thesis is that the notion of constitutive rule is explanatorily helpful because it gives a complete account of an important phenomenon in the social and legal domain, namely, that of artifactual entities endowed with statuses that can have emergent normative properties. Conceiving of these entities as rule-constituted artifacts is an important part of what H. L. A. Hart called “the internal point of view” toward law, and for this reason constitutive rules should be included in an explanation of that point of view as an integral part of the life of institutions. The structure of my argument will be as follows. First, I will provide an example of an important phenomenon in the internal point of view, namely, the fact that individuals can have normative reactions not about the specific regulation of an institution but about its underlying purpose and rationale—what in the legal domain is called the ratio of a norm. Then I will identify two reductionistic approaches on constitutive rules. The first approach is exemplified by Brian Epstein’s idea that the phenomena explained by constitutive rules are better explained in terms of metaphysical (grounding/anchoring) relations. The second kind of reductionism is instead exemplified by the idea (held by several authors, among whom Alf Ross, Riccardo Guastini, Frank Hindriks, and Francesco Guala) that the phenomena explained by constitutive rules can be accounted for in terms of regulative rules plus a certain terminology. I will try to show that neither of these approaches can explain normative reactions to the ratio of an institution from an internal point of view: While the first cannot explain the fact that the reaction is strongly normative, the second cannot explain the fact that the reaction is about the ratio of a normative entity. Constitutive rules can instead explain both things and should be preserved as an important notion for the analysis of institutional ontology. By way of constitutive rules we create something: immaterial, rule-based institutional artifacts that can have emergent normative properties. (shrink)

In the recent literature a number of free will skeptics, skeptics who believe that punishment is justified only if deserved, have argued for these two points: first, that the free will realist who would justify punishment has the burden of establishing to a high level of certainty - perhaps beyond a reasonable doubt, but certainly at least by clear and convincing evidence - that any person to be punished acted freely in breaking the law; and, second, that that level of (...) evidence is simply not there. In this paper I make two parallel points against a quarantine theory of criminal justice. First, the free will skeptic who would justify universal criminal quarantine is also faced with a burden of proof, the burden to establish to a similarly high level that no human being ever acts freely. Second, there is not sufficient evidence for that conclusion either. I believe that the quandary that this creates for criminal justice can be resolved by distinguishing the methods associated with a particular approach from the approach itself: if our choice is between the methods of punishment and the methods of quarantine, the methods that constitute punishment are, I would argue, morally preferable to those that constitute quarantine. Being part of the life of institutions requires a considerable amount of conceptual knowledge. In institutional settings, we must learn the relevant concepts to act meaningfully, and these concepts are internal in a peculiar way, namely, they are strictly relative to the rules of a given institution because they are constituted by those rules. However, institutions do not come out of nothing: They are inscribed in a social setting and this setting determines, at least in a broad sense, what is (...) the nature of the institution. Our social life therefore creates more or less defined contexts for meaningful institutional activities, and these contexts in their own turn involve concepts. In this paper, I address this question by distinguishing between three kinds of concepts relevant for an institution and trying to identify the different relations that these concepts have with constitutive rules. I then proceed to explain how this distinction can improve our understanding of practical reasoning in institutional context. (shrink)

In three experiments, we investigated the priming effects induced by an image change on a successive animate/inanimate decision task. We studied both perceptual and conceptual priming effects, under correct change detection and change blindness . Under correct change detection, we found larger positive priming effects on congruent trials for probes representing animate entities than for probes representing artifactual objects. Under CB, we found performance impairment relative to a “no-change” baseline condition. This inhibition effect induced by CB was modulated by the (...) semantic congruency between the changed item and the probe in the case of probe images, but not for probe words. We discuss our results in the context of the literature on the negative priming effect. (shrink)

Several authors have recently pointed out the hyper-mentalism of the standard mindreading models, arguing for the need of an embodied and enactive approach to social cognition. Various attempts to provide an account of the primary ways of interacting with others, however, have fallen short of allowing for both what kind of intentional engagement is crucial in the basic forms of social navigation and also what neural mechanisms can be thought to underpin them. The aimof the paper is to counter this (...) fault by showing that most of the primary ways of making sense of others are motor in nature and rooted in a specific brain mechanism: the mirror mechanism. I shall argue that the mirror-based making sense of others not only can be construed within the enactive approach to social cognition, but also allows us to refine it, supplying a plausible and unitary account of the early forms of social interaction. In this article, I argue that stability is one of the enabling conditions for epistocratic arrangements to function well and justify their claim right to rule. Against this backdrop, I demonstrate that advocates of strategies to allocate exclusive decision-making power to knowledgeable citizens fail to demonstrate that in a context marked by the fact of pluralism, liberal epistocracies will be stable. They could argue that liberal epistocracies will be stable because epistocratic arrangements are better equipped than democratic decision-making bodies to (...) produce outcomes that approximate the common good. They could argue that liberal epistocracies will be stable because there is a shared meritocratic set of values and ideas. Furthermore, they could opt for two standard liberal strategies, such as overlapping consensus and modus vivendi. Yet, in all cases, the argument for the stability of liberal epistocracies is not persuasive. (shrink)

Taking seriously the task of sustaining the democratic project requires debunking pessimism, thinking critically about what constitutes the distinctive character of democracy, and taking a future-oriented perspective on democratic transformations.

There is at least one immediate sense in which legal discourse is perspectival: it qualifies acts and facts in the world on the basis of rules. Legal concepts are for the most part constituted by rules, both in the sense that rules define these concepts’ semantic content and that, in order to engage with legal practice, we must act according to those rules, not necessarily complying with them but at least having them in mind. This is the distinctive perspective of (...) law: however, it would be misleading to think that this is the only perspective we can have in legal discourse. That of rule-constituted legal concepts is the fundamental perspective -- the inevitable presupposition of most legal assertions -- but other perspectives are possible on top of this fundamental background: perspectives on law, stemming from the basic perspective of law. -/- In this paper, I will try to argue that some different perspectives regarding law can be accounted for by analyzing different kinds of concepts that emerge in connection with legal institutions. My argument will consist of three steps as follows. First, I will explain how legal concepts are constituted by rules, referring in this regard to John Searle’s analysis of institutional concepts as it emerges in his Making the Social World, of 2010, and amending this analysis according to some criticisms that in 1986 Neil MacCormick had raised against Searle with specific reference to the legal domain. -/- Second, I will show that there are some kinds of concepts relevant for an institution which are not captured by Searle’s analysis in terms of constitutive rules, even if this is amended according to MacCormick’s criticisms. This I will do by considering the game of chess as a simple system of rule-constituted concepts (concepts such as 'checkmate,' 'bishop,' 'king'). I will consider four examples of perfectly legitimate assertions regarding a match of chess -- these being (1) ‘I won’; (2) 'you made a good attack'; (3) 'you are cheating'; (4) 'you made good use of the first-move advantage,' and I will show that, while the first three assertions can be analyzed in terms of concepts (those of 'victory,' 'attack,' and 'cheating') which are not constituted by the rules of chess but are rather common to several different competitive games, being typical of the broader practice of competitive game-playing of which chess is an instance, the fourth assertion includes a concept (that of 'first-move advantage') which is peculiar to chess, just like a rule-constituted element, but is not constituted by the rules of chess. This analysis will lead to a new categorization of institutional concepts. Apart from rule-constituted institutional concepts, which are the only ones recognized by Searle, in order to account for cases (1), (2), and (3) I will distinguish between three kinds of meta-institutional concepts, namely, goal-oriented, mode-oriented, and value-oriented meta-institutional concepts, and then I will introduce the category of para-institutional concepts to account for case (4). -/- Finally -- and this is the third step of my argument -- I will explain how these different kinds of institutional concepts appear when we adopt different perspectives on the institutional frameworks we deal with. This will lead us to a categorization of possible perspectives regarding law that corresponds to the previous one regarding concepts. There is first a structural perspective regarding the instantiation of institutional elements which clearly involves rule-constituted institutional concepts -- as when we say 'I am making a will.' There is then a teleological perspective regarding the goal of our institutional acts which calls into question goal-oriented meta-institutional concepts -- as when we say 'I wrote that will in order for you to have a distinctive right to my property.' Then, we can adopt a strategical perspective regarding some peculiar ways in which institutional acts can be performed, and this has often to do with mode-oriented meta-institutional concepts -- as when we say 'the Labour Party is making parliamentary obstructionism so that the Government will fall before the enactment of the labour reform,' or 'workers start today a work-to-rule action.' Clearly, we can also adopt an evaluative perspective over institutional facts or acts, and here typically value oriented meta-institutional concepts emerge -- as when we say 'that rule is clearly unjust' or 'that contract is unfair.' Finally, we can limit ourselves to a descriptive perspective on phenomena which are peculiar to a given institutional setting, and here para-institutional concepts are often useful -- as when we say 'the Italian electoral system before 1990 led to a sort of reform paralysis' or 'a strict use of the criterion requiring proof beyond any reasonable doubt can be expected to entail a low conviction rate.'. This paper discusses the explanatory power of discourse analysis, an approach to typically considered one of the main qualitative methods for data analysis. Although discourse analysis is typically not used to develop explanatory models, some have claimed that discourse models can causally explain social phenomena, such as institutional change. I analyze a case of institutional change to discuss and provide arguments for two claims. First, discourse analysis cannot generate causal explanations of social phenomena. Secondly, discourse analysis can generate non-causal explanations, (...) specifically constitutive explanations of social phenomena. The author intends to show how the criticism of Maurizio Ferraris to the correspon-dence of ontology and epistemology, which developed in the modern age, does not consider that the Thought of the transcendentalism is not the thought of the everyday language but rather a limiting concept. Therefore, the fair criticism to the pragmatism and to the post-modernism in the name of the “reality principle” cannot involve the ideas of the so-called idealists (Kant, Hegel, Gentile, Croce): to conceive the reality as (...) history, as the idealists do, has important ethical implications. This article sheds light upon the role of the audience in the construction and amendment of populist representative claims that in themselves strengthen representative-represented relationships and simultaneously strengthen ties between the represented who belong to different constituencies. I argue that changes in populist representative claims can be explained by studying the discursive relationship between a populist representative and the audience as a conversation in which both poles give and receive something. From this perspective, populist representative claims, I also argue, can (...) be understood as acts of bonding with the intended effect of constituting ‘the people,’ and inputs from the audience can be seen as conversational exercitives. Populist appeals therefore may change when the audience enacts new permissibility facts and signals to populist representatives that there is another way to strengthen relationships between several individuals belonging to otherwise-different constituencies. Food allergy represents an increasing public health issue, and a large number of food control authorities have provided regulations aimed to minimize the risk of allergic reaction for sensitized consumers. The Food and Agriculture Organization of the United Nations together with the World Health Organization established the Codex Alimentarius Commission whose main goal is to protect the consumers’ health. To purse this task the Commission listed the foods and ingredients causing the most severe allergic reactions that should be labelled. It (...) has been reported that some cases of specific foods hypersensitivity display a different prevalence among different Countries. Thus, the European Union drew up a list of mandatory allergens longer than that provided by Codex Alimentarius. As a consequence of the complexity of the legal phraseology of the European Union and/or European Community the Regulations and/or Directives were differently translated in all EC/EU official languages determining possible misinterpretations of the legislation. Moreover, food labelling regulations were also established with the goal to promote the consumers’ conscious choice about what they eat. Starting from the case of the fermented beverages, we analysed the European legislative scenario concerning the allergen labelling of the last fifteen years, highlighting that mistranslations, misinterpretations and lack of information in the EU Regulations might lead to health and ethical issues. When witnessing someone else's action people often take advantage of the same motor cognition that is crucial to successfully perform that action themselves. But how deeply is motor cognition involved in understanding another's action? Can it be selectively modulated by either the agent's or the witness's being actually in the position to act? If this is the case, what does such modulation imply for one's making sense of others? The paper aims to tackle these issues by introducing and discussing a (...) series of experimental studies showing how body and space may constrain one's own motor cognition reuse in understanding another's action. These findings, I shall argue, may shed new light on the mechanisms underlying the primary ways of identifying ourselves with other people and of being connected to them . (shrink)

In this paper I discuss the ontological status of actants. Actants are argued as being the basic constituting entities of networks in the framework of Actor Network Theory (Latour, 2007). I introduce two problems concerning actants that have been pointed out by Collin (2010). The first problem concerns the explanatory role of actants. According to Collin, actants cannot play the role of explanans of networks and products of the same newtork at the same time, at pain of circularity. The second (...) problem is that if actants are, as suggested by Latour, fundamentally propertyless, then it is unclear how they combine into networks. This makes the nature of actants inexplicable. -/- I suggest that both problems rest on the assumption of a form of object ontology, i.e. the assumption that the ontological basis of reality consists in discrete individual entities that have intrinsic properties. I argue that the solution to this problem consists in the assumption of an ontology of relations, as suggested within the framework of Ontic Structural Realism (Ladyman & Ross, 2007). Ontic Structural Realism is a theory concerning the ontology of science that claims that scientific theories represent a reality consisting on only relation, and no individual entities. -/- Furthermore I argue that the employment of OSR can, at the price of little modification for both theories, solve both of the two problems identified by Collin concerning ANT. -/- Throughout the text I seek support for my claims by referring to examples of application of ANT to the context of networked learning. As I argue, the complexity of the phenomenon of networked learning gives us a convenient vantage point from which we can clearly understand many important aspects of both ANT and OSR. -/- While my proposal can be considered as an attempt to solve Collin's problems, it is also an experiment of reconciliation between analytic and constructivist philosophy of science. -/- In fact I point out that on the one hand Actor Network Theory and Ontic Structural Realism show an interesting number of points of agreement, such as the naturalistic character and the focus on relationality. On the other hand, I argue that all the intuitive discrepancies that originates from the Science and Technology Studies’ criticism against analytic philosophy of science are at a closer look only apparent. Or is it legitimate, for example, to identify a precise Italian philosophy and distinguish it from a French one? In the case it is legitimate, is it also beneficial to speak in such terms? Which are the risks and advantages of using national or territorial criteria as a principle for identifying different traditions of philosophical (...) thought? The essay analyses these questions, going through the main stages of the Italian philosophical historiography from Bertrando Spaventa’s theory of the “European circulation of Italian thought” to the “Italian Theory” of Roberto Esposito. This article investigates why Lucretius does not dedicate any section of his poem to atomic size or provide a technical term to describe the concept. This absence is particularly significant because Epicurus’ Letter to Herodotus both uses the term μέγεθος to indicate atomic size and contains a passage reporting specifically on this property. First, the article argues that atomic size and shape are causally redundant in Epicurus’ ontology. Second, it demonstrates that the origin of both shape and size is found (...) in the smallest magnitudes in Epicurean physics, the minima. Drawing on these findings, it concludes that, since atomic size violates the law of parsimony, it is a superfluous entity in the Epicurean system. After analysing passages from the De rerum natura, it suggests that the absence of atomic size in Lucretius may be deliberate. Lucretius’ microphysics works perfectly without introducing a philosophical notion of atomic size, and is more economical and efficient than that of Epicurus. (shrink)

It has been widely demonstrated that dreaming occurs throughout human sleep. However, we once again are facing new variants of the equation “REM sleep = Dreaming.” Nielsen proposes a model that assumes covert REM processes in NREM sleep. I argue against this possibility, because dream research has shown that REM sleep is not a necessary condition for dreaming to occur. [Nielson].

The study of perception has often taken the perspective of vision and, to date, less attention has been dedicated to the other senses, including hearing. Research in auditory perception itself has been predominantly occupied with sounds, overlooking further aspects of the auditory perceptual experiences that we ordinarily undergo. Carrying out an inquiry in auditory perception, I present an account of the material objects of auditory perceptual experience. Examining the objects of auditory perceptual experience via the notion of force, a power (...) essential to material bodies, we come to appreciate that we are ordinarily auditorily presented with material bodies. A set of auditory perceptual experiences, such as that of the crunching of a carrot, evidently present us with material bodies in presenting us with bodies in interaction, exerting and being governed by force. This will further provide an opportunity to uncover biases in our understanding of what constitutes objects of material nature and how we consider these to be present in perceptual experience. The first part of this thesis looks into the sources of these biases, beginning with a sceptical challenge set out by Hume and considering a set of responses to this. Hume is sceptical of the idea that what we perceive continues to exist unperceived which we may derive from experience of material bodies. As I will observe in chapter two, philosophers have often assigned a central role to spatial aspects of material bodies in the resolution of this issue. Given so, in chapter three, I identify the source of a challenge as to whether the auditory presents us with material bodies in the thesis that auditory perceptual experience does not present us with spatially extended bodies. In the second part, I develop my positive account. In chapter four, posing a challenge to indirect accounts of auditory perception, according to which we hear material bodies indirectly via auditory perceptual experience of sounds, I begin to put forward the claim that there is a set of cases of auditory perceptual experience in which we do appear to be presented with material bodies. In chapter five, I move on to assess our conception of the material taking a short historical excursus in the understanding of the power of bodies to exert and be governed by force. In chapter six, I turn to consider what it means to be perceptually sensitive to this condition of materiality and in what sense such power can be considered to be present in auditory perceptual experience. In chapter seven, I finally point to a further direction of inquiry into mind-independence that the account developed in this thesis opens. (shrink)

Philosophers have expressed concerns about elite capture at various stages of the democratic decision‐making process. However, there has been no sustained normative analysis of government‐driven feedback platforms that enable different actors to formulate recommendations for revising or canceling existing laws and policies. My article addresses and fills this gap. I contend that government‐driven feedback platforms serve a dual purpose of influencing the policy‐making process and demonstrating that decisions are open to revision. I also argue that these feedback platforms are intended (...) to generate a normatively salient, forward‐looking, and balanced integration of technical knowledge and local knowledge, establishing the epistemic foundation for future deliberation. I then provide three normative standards that serve as a guide to balance expert knowledge with citizens' experience and values. (shrink)

Between Leopold Ranke and Eduard Gans - Certain circumstances and stylistic considerations lead us to believe that the manuscript MS. 114 in the Mendelssohn Archive at the Staatsbibliothek in Berlin is evidence of a course in "Contemporary History" held by Leopold Ranke at the city’s university in the summer term of 1827. The course was on the chronological history of the French Revolution. Ranke had already dealt with the same subject the year before, though in a less detailed manner. And (...) it was not until 1875 that he published a work on the period of the Revolution, but focussing solely on the war between the European powers in 1791-1792. Hence the importance of the new manuscript - in Felix Mendelssohn Bartholdy’s own hand - which, previously, had been mistakenly connected with the teaching of the Hegelian jurist Eduard Gans. Mendelssohn attended his course on the French Revolution in the summer of 1828. (shrink)

In the era of fake news, truth has become a different and more urgent political problem than the traditional issues of the arcana imperii and the lies of the rulers. Starting from this observation, and deepening some considerations contained in the essay by Hannah Arendt _Thruth and Politics_, the article offers a worried report on the possibility of truth (scientific and factual) not to be reduced to mere opinion among others, and concludes that only a loyal collaboration between epistemic authorities (...) and politics can make the judicial road for the protection of truth less attractive. The sense of power has a double face : on the one hand, it is the will to power as a force impelling to action; on the other hand, it is a basic state of mind which essentially conditions our intellectual approach to reality. It is in this second perspective that we see why the interpretation of a series of relationships between man and reality in terms of power, inconceivable among the Zunis or the Arapesh, is natural to the Western (...) mind, or, at any rate, is more or less in agreement with its general attitude. As Mannheim observed, “We enter at birth a world which has already been interpreted, a world which has already been made comprehensible, and each of whose parts has a meaning.” In this study we propose to examine to what degree and through what modes of expression this age-old spiritual conditioning has influenced our view of the world and of the realities of existence. La filosofia italiana è viva e vegeta. A testimoniarlo è il successo internazionale di cui gode ciò che è stato definito Italian Thought. Ma che cosa rende il pensiero italiano così apprezzato e studiato all’estero? Vi è qualcosa che accomuna, pur nella loro differenza tematica, i protagonisti della filosofia italiana e che permette di individuare un fil rouge – da Dante a Vico, da Machiavelli a Gramsci –, senza che per questo si debba parlare di una tradizione nazionale unitaria? E (...) che cosa vuol dire ripensare tale tradizione? È possibile farlo in modo non descrittivo-ricostruttivo? Ossia in modo tale da evitare quell’approccio “museale” volto solo a conservarne il glorioso passato, adottando invece un’altra prospettiva tesa a ripensarla, rivitalizzarla e renderla operativa nell’attualità? L’obiettivo del presente saggio è quello di rispondere ai suddetti interrogativi, mostrando come alcuni dei principali interpreti del pensiero italiano – da Spaventa a Gentile fino a Garin e Esposito – si rivolgano al patrimonio filosofico che ci precede individuando le caratteristiche distintive della tradizione nazionale con l’intento di renderle operanti e funzionali al proprio tempo. Back in vogue today is the tendency of Italian philosophy toward reflection on itself that has always characterized an important part of our historiographical tradition. The present essay firstly analyzes the various interpretative positions in respect to the legitimacy, the risks, and the benefits of such a discourse, which intends to distinguish the different traditions of thought by resorting to a criterion of territorial or national kind. Secondly, the essay examines diverse paradigms that identify – in “precursory genius”; in ethical (...) and civil vocation; and in “living thought” – the distinctive hallmark of the Italian philosophical tradition from the Renaissance to today. Is the negligence standard in accident law acceptable to the egalitarian? The egalitarian - the egalitarian who would compensate only losses for which the actor was not responsible - cannot accept either a system of strict liability for all accidents or a system of social insurance for all accidents. A system of tort law acceptable to the responsibility - egalitarian must be a system based on negligence. But what will negligence mean? A negligence system in which the notion of reasonableness (...) is based on efficiency, I argue, is a system that redistributes wealth from the less well off to those better off. I consider alternative notions of reasonableness, ending up with a principle of proportional responsibility and distinguishing between commercial and non-commercial cases. (shrink)

In this paper I propose a form of free will fallibilism. Unlike the free will realist who is fully persuaded that we have sufficient evidence of freedom to justify holding individuals morally responsible for what they do and imposing punishment, and unlike the free will skeptic who is fully persuaded that we do not have enough evidence to believe that we face a future of open alternatives, the free will fallibilist will believe that we have enough evidence to justify a (...) belief in freedom for some purposes but not for others. Along the way I argue that deliberation-compatibilism of the sort recently defended by Pereboom is subject to a very familiar sort of counterexample. The question that concerns me the most is whether punishment—this brutal institution that disposes of the lives of countless of our most vulnerable citizens—can be justified. I think it cannot, precisely because there is not sufficient evidence that human beings are free to choose between branching alternatives and so deserve to be treated like that. At least, if there is such justifying evidence it is more or less completely balanced by evidence that all events including human actions have causes. Moreover, I find compatibilism utterly unpersuasive. At the same time, I believe that I am a free agent; what I do is in large part up to me. I believe that the explanation of action cannot be reduced to causal explanation, and I believe that the logic of action requires a notion of branching time. I have two pictures of the universe; which of the two pictures I may rely upon will depend upon just what it is that I intend to do. Between the problem that preoccupies me, punishment, and my day-to-day choices, there is a wide gap. There are a lot of choices that, on the axis of justification, fall in between the two, many of them choices about how to treat those around us: whether to snub a friend who has insulted me, whether to castigate her, whether to reward a kind act with praise. Where to draw the line is a topic for another paper. The only principle that right now seems to me firm enough to act upon is this: the greater the likelihood of doing harm, the less likely the choice is to be justified. (shrink)

This article is the synthesis of a research project that took place in Bamako, Mali, which observed the experimentations in new conditions of living set in place by sub-Saharan migrants. This chronicle suggests that migration constitutes a subversive and creative subjective experience. Migrants in Bamako, far from being reduced to a mere clandestine and over-exploited work force within the economies of the core of the capitalist system, create their own conditions of valorization, in autonomy, through a direct control of their (...) power to invent and through renewed forms of social cooperation. It has been proposed that, Under the restriction of singular terms to proper names, Singular de re propositions would be equivalent to certain de dicto propositions. But that is so only if a certain thesis--A thesis which is itself irreducibly de re--Is true of proper names. The conclusion is that the restriction to proper names is not, By itself, Sufficient to render the de re and de dicto equivalent.

This paper addresses the philosophical and cultural significance of the concept of «sobornost’» both in the cultural context of Silver Age and in the historical context of World War I. The analysis of Ivanov’s thought is based on a philological approach of his essay «Legion and Sobornost’», in which the author explains his understanding of such terms as organisation, cooperation, collectivism in order to clarify his own idea of collegiality and the ontological opposition of the title. The opposition between legion (...) and collegiality duplicates the confrontation between Germany and Russia. Vyach. Ivanov first conducts a cultural analysis of such a confrontation, and criticizes Nietzscheanism in German culture at the turn of the 19th and 20th centuries. He proves the false understanding of the organization in modern German culture. In his opinion, the main values of freedom and personhood are the measure of lies or truth. In the last chapter of his essay, Vyach. Ivanov gives his own definition of collegiality, not referring to Russian thinkers, but quoting the two cities of St. Augustine’s thought. The author of the article shows that the culturological perspective is overcome by the Christian anthropological and mystical perspective, which proclaims humanism and Christocentrism. Therefore, accordind to Vyach. Ivanov, the word “sobornost” is a “universal word”, which mentions that the true social union has Christ as its center. In this sense, the concept of collegiality signifies the same mystical reality that the City of God of St. Augustine. (shrink)

Five purposive relations are investigated: endeavoring, endeavoring for a certain purpose, bringing something about in a certain endeavor, bringing something about for a certain purpose, and bringing something about intentionally. No satisfactory analysis of these terms has yet been proposed, either in mentalistic -- belief, desire, intending -- or in action terms. While bringing something about for a certain purpose may seem too obscure to be taken as a primitive, there are at least two arguments in favor of it. First, (...) no analyses in terms of other primitives has worked; second, the rather natural definitions of the other notions which it makes possible take us some way toward understanding the structure of intentional action. Ibn Bāğğa’s commentary on Aristotle’s On Generation and Corruption (Kitāb al-Kawn wa-l-fasād, Latin De generatione et corruptione) is one of the first commentaries to elaborate on the essential aspect of Aristotle’s text, that is, the analysis of change (μεταβολή, taġayyur). The commentary’s extant parts comprise a consecutive exposition of the contents of Aristotle’s work. However, the commentary may be read more as an introduction or a guide to the topic of generation than as a substitution for the original, as the (...) paraphrases by Averroes seem to have become in the later tradition. The present study provides a new critical edition of the Arabic text and, for the first time, an English translation and a study of the structure of the commentary on the basis of the only two known manuscripts. In this article I examine three examples of philosophical theories of scientific representation with the aim of assessing which of these is a good candidate for a philosophical theory of scientific representation in science learning. The three candidate theories are Giere's intentional approach, Suárez's inferential approach and Lynch and Woolgar's sociological approach. In order to assess which theory is more promising, I will compare the three candidate theories to two aspects of scientific representation in science learning that emerge from empirical (...) research on science learning. I label these aspects as the intentional and normative character of scientific representation in science learning. As I argue, whereas the other competing accounts of scientific representation can only capture one of the two aspects highlighted in this article, the inferential conception has the capacity to capture them both in a coherent way. Thus, I conclude that the inferential conception seems to be a fruitful philosophical theory of scientific representation in science learning. (shrink)

This thesis is concerned with John Stuart Mill’s democratic theory. In chapter I, I examine the relations between political philosophy and political theory and science before providing a detailed outline of the aims of the dissertation. In chapter II, I argue that in order to reconcile the concepts of progress and equality within a utilitarian theory, a Millian political system needs to devise institutions that promote general happiness, protect individual autonomy, safeguard society from mediocrity. Chapter III discusses what different authors (...) have said about Mill and liberty, then explores James Mill’s theory of education and Coleridge’s influence on John Stuart Mill’s thought. I conclude by criticising Richard Arneson’s interpretation according to which the Considerations and On Liberty are inconsistent, and some of Gregory Claeys’ conclusions on Mill and paternalism. Chapter IV explores the methodology of the social sciences and the philosophy of history as found in Mill’s writings; then it considers Mill’s thought in regard to his father’s Radical proposals. I also discuss at some length the idea of the tyranny of the majority. Chapter V begins with a discussion of Hanna Pitkin’s theory of representation. I then provide a critical account of Richard Krouse and Nadia Urbinati’s interpretations of Mill. I conclude by arguing that, in a Millian democracy, the higher is the degree of complexity or the need for expertise in dealing with affairs, the greater is the bearing of the principle of competence in assessing whether a representative should act as a trustee or a delegate. I also introduce the idea of rational debate as a sort of ‘influence multiplier’, arguing that this would help to make a democracy rational and effective along Millian lines. In the last two chapters, I stress the relevance of Mill’s political philosophy as for some contemporary issues (nationalism, European federalism, current social and economic changes) while suggesting some potential further investigations, and summarise my conclusions. Le rejet de End of Track de Mou Tunfei (fin années 60), film “invisible”, jamais distribué, prouve à quel point les thématiques abordées (homosexualité, différence de classes, nihilisme) étaient taboues pour toute une génération. Banana Paradise (années 80) évoque la façon dont deux frères d’armes survivent en usurpant l’identité de camarades décédés, et finissent par s’épanouir dans une société en exil taraudée par la mémoire du continent. Enfin, Gf/Bf (années 2000) développe des thématiques jadis censurées (homosexualité, démocratisation) et qui refont (...) surface via le prisme du triangle amoureux. Malgré leur hétérogénéité, ces films permettent de constituer une histoire de ce rapport fraternel dans des contextes ambigus et dissonants ; à travers trois films d’époques différentes, je retrace l’évolution dans le temps de la représentation de l’amitié entre hommes, une évolution qui révèle un « changement de paradigme » au sein même de la société taiwanaise. The paper discusses non-pharmaceutical interventions (NPIs) as a collective form of protection that, in terms of health justice, benefits groups at risk, allowing them to engage in social life and activities during health crises. More specifically, the paper asserts that NPIs that realize social distancing are justifiable insofar as they are constitutive of a type of social protection that allows everyone, especially social disadvantaged agents, to access the public health sphere and other fundamental social spheres, such as the family and (...) civil society. The opposition between nature and culture has always been paradigmatic in the philosophy of society, and in this sense it is certainly striking that, in contemporary theories of collective acceptance in social ontology—theories which actually entail the presence of individual mental content in the form of beliefs—the shaping role of culture has not found significant recognition. However, it cannot but be trivially true that cultural presuppositions play a role in the maintenance and development of beliefs on rules and other kinds (...) of abstract artifacts. But once we recognize that the reality of social institutions is at least culturally-dependent, the question emerges whether there is still room for nature as a possible determinant of social reality. Many authors maintain that there is and argue that there are objective natural features shared by human beings which are necessary conditions to explain the emergence of institutional structures within society. This is a culture-independent relation between nature and social institutions. In this paper, however, I will try to argue that there is another, very peculiar, way in which nature can work as a possible determinant of social reality, a way which is instead culture-dependent. In particular, I will give three examples of this kind of culture-dependent relations—examples about states, corporations, and contracts—and I will introduce a new concept to account for it, that of “institutional mimesis.” I will then provide an explanation of how institutional mimesis can have an impact on the content of collective acceptance by appealing to two influential theories in contemporary cognitive psychology. Finally, I will explain the ontological significance of institutional mimesis using Ian Hacking’s concept of historical ontology. (shrink)

Inextricably bound up with the philosophy of John Searle is, famously among philosophers, the concept of constitutive rules. Less well known, however, is that starting in the 1970s, a conversation on this topic emerged in Italian legal philosophy, reaching a depth and complexity hardly matched anywhere else in the world. This is due chiefly to the work of Gaetano Carcaterra and Amedeo G. Conte. This chapter moves that conversation forward by connecting these different research lines: It shows how the evolution (...) of Searle’s concept of a constitutive rule can ground a critique of Conte’s own concept of a constitutive rule, and how, conversely, those developments in Searle’s ideas are consistent with some sound critiques Conte aimed at Searle’s original thinking on constitutive rules. Are there distinct roles for intention and motor representation in explaining the purposiveness of action? Standard accounts of action assign a role to intention but are silent on motor representation. The temptation is to suppose that nothing need be said here because motor representation is either only an enabling condition for purposive action or else merely a variety of intention. This paper provides reasons for resisting that temptation. Some motor representations, like intentions, coordinate actions in virtue of representing outcomes; but, (...) unlike intentions, motor representations cannot feature as premises or conclusions in practical reasoning. This implies that motor representation has a distinctive role in explaining the purposiveness of action. It also gives rise to a problem: were the roles of intention and motor representation entirely independent, this would impair effective action. It is therefore necessary to explain how intentions interlock with motor representations. The solution, we argue, is to recognise that the contents of intentions can be partially determined by the contents of motor representations. Understanding this content-determining relation enables better understanding how intentions relate to actions. (shrink)

This article criticizes a view about the interpretation of human action, labeled in the text as interpretivism. This view posits a sharp separation between the natural and social sciences, to the effect that the methods of the latter cannot be applied to the former. I criticize this standpoint by reconstructing a case of educational research. As I argue, the case I analyze indicates that the arguments in support of interpretivism are contradicted by what social researchers can actually achieve. The notion of a minimal form is defined as an extension of the notion of a normal form in λ-β-calculus and its meaning is discussed in a computational environment. The features of the Knuth-Gross reduction strategy are used to prove that to possess a minimal form, for a generic term, is a semidecidable predicate.

Simulation theories of social cognition abound in the literature, but it is often unclear what simulation means and how it works. The discovery of mirror neurons, responding both to action execution and observation, suggested an embodied approach to mental simulation. Over the last years this approach has been hotly debated and alternative accounts have been proposed. We discuss these accounts and argue that they fail to capture the uniqueness of embodied simulation (ES). ES theory provides a unitary account of basic (...) social cognition, demonstrating that people e their own mental states or processes represented with a bodily format in functionally attributing them to others.
